I am writing to formally address a matter regarding the wrongful withholding of funds and the subsequent false accusation of fraud by fifth third bank. I previously filed a claim against your institution concerning the deposit of a check that was unfairly held and not returned despite assurances to the contrary. Contrary to the representations made by your institution, my account was not closed, and the funds were not returned as promised. In addition to these failures, I recently received correspondence from the Department of the Treasury stating that due to my endorsement of the check, I am precluded from filing a claim with them. However, the banks actionsincluding the false allegation of fraud and the unlawful withholding of my fundsconstitute a violation of my rights under various state and federal statutes. Violation of the Uniform Commercial Code ( UCC ) : Under the Uniform Commercial Code, specifically UCC 3-304, a bank is required to honor checks unless there is a valid reason for non-payment, such as a stop payment order or insufficient funds. Your refusal to process the check and return the funds is a direct violation of these provisions. False Accusation of Fraud : The false accusation of fraud, without substantiated evidence, may violate state consumer protection laws and could be considered defamation under state tort law. Please respond in writing within 3-5 business days. If this matter is not resolved satisfactorily, I will be compelled to pursue further legal remedies, including filing complaints with the Consumer Financial Protection Bureau ( CFPB ), my states Attorney Generals office, and exploring civil legal action for recovery of my funds. Please see previous report that was closed without any investigation XXXX XXXX XXXX which was completely bias and unfair. My money has been stolen by this bank and must be returned immediately
