I am writing to formally file a complaint regarding the inaccurate and delayed reporting of my mortgage account to your credit reporting agency. I have recently reviewed my credit report and noticed that my mortgage payment history, specifically for the following months was not reported accurately and as a result was reported late. 30 Days Late : XXXX, and XXXX 60 Days Late : XXXX, and XXXX My mortgage account number is XXXX, and I have always made timely payments in accordance with my agreement with Rushmore Servicing. However, despite my consistent payment history, this information does not appear to have been reported to your agency in a timely manner. The inaccurate reporting is resulting from Rushmore Servicing Escrow Analysis incorrectly collecting property taxes. They have finally corrected the escrow analysis, and updated my payments, but have yet to credit the overage from the County. The County has already sent the refund back to Rushmore Servicing, but Rushmore has not applied the credit to may account. Each time I make the correct payment, they are not applying the payment to the monthly amount due, which is further causing more lates and more service fees to be added. Attached to this letter is my proof of payments, Communication with the County on Tax Credit. I can provide the emails, but will need the ability to forward them to you directly. The failure to accurately report my mortgage payments is negatively affecting my credit score and is not reflective of my financial responsibility. As a result, I am requesting that you investigate this matter immediately and update my credit report to reflect my true payment history. I also kindly request that you provide me with written confirmation that this issue has been resolved and that the late payment ( s ) are corrected on my credit report. Please consider this letter a formal request for an investigation and correction, as required under the Fair Credit Reporting Act ( FCRA ). I expect this matter to be resolved promptly and for my credit report to be updated within the legally required 30-day timeframe. Thank you for your attention to this matter.
