Consumer Narrative
XXXX XXXX XXXX XXXX XXXX XXXX, NJ XXXX XX/XX/2024 Experian XXXX XXXX XXXX XXXX, TX XXXX Subject : Formal Dispute and Request to Remove XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX Dear Experian, I am writing to formally dispute the inclusion of XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX on my credit report. I have notified this debt collection agency that I do not intend to pay the alleged amount listed on my file. Furthermore, I have not received any written validation of this debt as required by 15 U.S.C. 1692g under the Fair Debt Collection Practices Act ( FDCPA ). Under 15 U.S.C. 1692g ( a ), a debt collector is required to provide the consumer with a written notice within five days of the initial communication, containing : 1. The amount of the debt. 2. The name of the creditor to whom the debt is owed. 3. A statement of the consumer 's right to dispute the debt within 30 days. 4. A statement that upon written dispute, the debt collector must provide verification of the debt or a copy of a judgment. 5. The name and address of the original creditor if different from the current creditor. To date, I have never received such a notice, which is a direct violation of the FDCPA. Without proper validation, this debt must be considered invalid. Additionally, under 15 U.S.C. 1692g ( b ), debt collectors must cease collection efforts until they provide verification of the debt. In conjunction with 15 U.S.C. 1692c, which protects consumers from further communication upon written request, I am demanding that XXXX XXXX XXXX and XXXX XXXX XXXX XXXX cease all collection activity and that Experian immediately investigate and remove this entry from my credit report. Please consider this letter as my formal dispute under the Fair Credit Reporting Act ( FCRA ) and request for reinvestigation. I demand written confirmation once the disputed account has been removed from my report. If Experian requires further information to process my dispute, please contact me at the address provided above. Thank you for your prompt attention to this matter. I look forward to your response within the statutory XXXX period. Sincerely, XXXX XXXX
