We are in the process of selling our home to prevent foreclosure. In 2021 three separate Cashier 's check totaling XXXX were cashed and never applied to our account. They are saying that these payments were rejected and sent back to me. My bank has sent proof that two of these cashier 's checks were cashed and negotiated by PHH bank. I sent the email from XXXX XXXX XXXX showing the front and back ( # XXXX the amount of XXXX and # XXXX {$9000.00} were cashed and endorsed " FOR DEPOSIT ONLY XXXX XXXX XXXX ''. I have been going back and forth with their CSRs and they keep repeating that the checks were returned back to me. They don't seem to understand that they could not have sent them back to me once they were deposited into their account. What they should have done was cut me a check for the checks that they had cashed and not credited to my account. I am simply asking for the funds to be sent back to me so i can sell this house. Also, they have included an additional {$19000.00} to the payoff amount previously reported to me. I believe they have double the attorney fees in the " Recoverable balance '' that was sent to the title company halting the proposed sale of my property. Per FDIC rules the cashier 's check could not have been returned to me after they endorsed them, anyway. I have asked them to prove that they sent the checks back to me and they haven't because they didn't, it would have been impossible. I BELIEVE THAT THEY ARE TAKING ADVANTAGE OF ME BECAUSE OF MY AGE.
