*****THIS IS A TRANSCRIPT OF ATTACHMENTS *** Discover Bank XXXX XXXX XXXX XXXX XXXX XXXX XXXX UT XXXX XXXX # XXXX or account ending in XXXX To Whom It May Concern : Pursuant to 15 USC 1692c ( c ) consumer is requesting a CEASE AND DESIST OF ALL COMMUNICATIONS IN AN ATTEMPT TO COLLECT AN ALLEGED DEBT. Definitions Mediums include but are not limited to : * Employers * Major CRAs and their subsidiaries * 3rd party reporting agencies * Secondary 3rd party reporting agencies * Relations * Rental agencies * Lenders Reason ( s ) for applying 15 USC 1692c ( c ) Fraud Inaccuracies Non response Non compliance Creditor has repeatedly violated : * FCRA 623 ( a ) ( 1 ) ( c ) as consumer has, over the last 4 years, made creditor aware of MULTIPLE INACCURACIES that creditor refuses to correct and continues to furnish to 3rd party and 3rd party secondary reporting agencies. Creditor is knowingly continuing to do so. Creditor will not be AFFORDED THAT OPPORTUNITY any longer. Consumer requires IMMEDIATE REMOVAL from consumers credit report. Including but not limited to these agencies IMMEDIATELY : * XXXX * XXXX * XXXX * XXXX * 15 USC 1681 ( e ) ( b ) states that furnishers must comply with MAXIMUM ACCURACY standards. Creditor continues to use deceitful payment history and updating tactics to prolong the 7 year statute of limitations on reporting a debt to 3rd party agencies. Discover continues to report payments that HAVE NOT BEEN MADE only to report a CHARGE OFF the month following them reporting 5 or 6 payments. Thier ability to do this must be deleted from consumers report BASED ON THIS INACCURACY ALONE. Failure of DISCOVER AND ITS SECONDARY, XXXX, TO ACT AND REMOVE IMMEDIATELY will cause a liability on consumers next action which will be an FTC report and a complaint filed with CFPB, to which both organizations are fully aware of consumer and has filed reports and complaints on consumers behalf in the past. * Consumer will seek and may be awarded {$1000.00} per organization, per occurrence. Sample of the reporting tactics being used to prolong and extend statute of limitations. I have not, nor will I, made a payment to this account. Company continues to report CO, blatantly make up payments that havent been made, constantly report XXXX and XXXX, then a payment, all in a concerted effort to deceive agencies and prolong statute of limitations. This tactic is illegal and consumer is PROTECTED FROM IT. This is fraud. Fraud Lawful Definition : In law, fraud is intentional deception to deprive a victim of a legal right or to gain from a victim unlawfully or unfairly. Creditor is supplying INACCURATE and deceitful payment history across all CRAs : other violations of 1681 ( e ) ( b ) : * Creditor is supplying 2 different account numbers to all 3 rd party agencies and secondary agencies. This is an inaccuracy requiring deletion. * * * * Creditor has marked account charged off and is refusing to send a 1099-c as proof it has used account as a tax write-off. If company has written account off then this is no longer classified as debt. Its classified as INCOME. Income can not be debt. Discover is using the charge off classification fraudulently to maximize leverage using the worst and most damaging classification possible. Its refusal to send 1099-c as proof, is proof enough. * Company is reporting an inaccurate closed date for the purposes of defrauding consumer and prolonging statute of limitations to continue to have leverage to attempt to collect a debt. This is grounds for IMMEDIATE REMOVAL OF THIS ACCOUNT FROM CONSUMERS CREDIT REPORT. Willful and further violations of the law will result in legal action. Consumer will accept nothing but full and complete DELETION from consumers credit report as a satisfactory outcome. If company does not agree to that outcome this matter will be escalated without hesitation. Deletion must be agreed to and granted from the following IMMEDIATELY : - XXXX - XXXX - XXXX - XXXX - Any secondary not listed Discover and any of its subsidiaries reports to. Credit profiles are accessible to consumer. Any attempt to further defraud consumer ie, tamper with accounts in order to change information will be considered an attempt to communicate and any changes made or attempted to be made will be reported to the FBI and XXXX. Creditor has 15 days to remove account. Failure to do so will result in FTC complaint followed by legal action. Cease and Desist is valid as of XX/XX/year>. It is my contention : I have not supplied proof under the doctrine of estoppel by silence, XXXX XXXX XXXX XXXX XXXX XXXX, I presume that no proof of the alleged debt, nor the classification used thereof, nor any such debt, in fact therefore exists.
