I am submitting this complaint regarding the inaccurate reporting of late payments and balances on my credit report by Experian. Experian is reporting late payments for the accounts listed above, including a XXXX-day late payment mark. This reporting violates 15 U.S.C. 1666b ( a ) of the Consumer Credit Protection Act, which explicitly states that a creditor may not treat a payment on a credit card account as late unless reasonable procedures have been adopted to ensure the periodic statement is mailed or delivered at least 21 days before the payment due date. The creditors associated with these accounts failed to meet this standard, making these late payment marks unlawful. Despite my repeated disputes, Experian has failed to properly respond or adequately investigate and correct these errors. Under 15 U.S.C. 1681i ( a ) of the Fair Credit Reporting Act ( FCRA ), credit reporting agencies are required to conduct a reasonable reinvestigation of disputed information and delete or correct inaccuracies promptly. Experians continued failure to comply with these obligations has caused damage to my credit reputation and financial well-being. Experian has my personal information on file and therefore knows my identity. There is no valid reason for this failure to take appropriate corrective actions.
