I recieved a notice of potential lawsuit for a debt I have no knowledge of. I requested for the debt to be verifed to me by the collector, in this case Midland Credit Management. I requested the items I have the right to collect per Fair Debt Collection Practice Law at the advisement of my attorney. The original request was made via mail and sent on XX/XX/2024. I then received another letter, to an old address that I have no association with and was passed along to me again. So twice, once via mail and once via CFPB I have requested the items to validate the debt according to my lawyer : 1. Verification of the Debt Creditor Information : Provide the name and address of the current creditor, along with the account number and the amount you claim is owed. Original Creditor : If different, include the name, address, and account number of the original creditor, the amount owed when transferred, and any other names by which I might know them. Also, specify when the current creditor obtained this debt and from whom. Basis of the Debt : Provide documentation supporting my legal obligation to pay, including original contract with my signature, statements, payment history or records related to the validation of this debt. Assignment Contract : Provide a copy of the purchase agreement/assignment contract that shows the transfer of the debt from the original creditor to the current creditor ( your company ). Third-Party Obligation : If this debt was originally another party 's responsibility, identify them and provide documentation explaining why I am now liable and the document I signed taking on this debt. 2. Amount and Age of the Debt Billing Statements : Provide the billing history for this alleged debt, complete payment history so I can have proof the amount would be correct. Debt Details : State the amount when you acquired the debt, the date of acquisition, and any additional interest, fees, or charges added since the last billing statement. Explain how these are authorized. Payments and Adjustments : Itemize any payments, reductions, or adjustments since the last billing statement, including dates and amounts. Delinquency Information : State when the debt became due, when it became delinquent, and the date of the last payment. Statute of Limitations : Confirm whether this debt is within the statute of limitations, including how you determined the expiration date. 3. Your Authority to Collect the Debt Licensing Information : Provide proof of your firms authority to collect debts in my state, including any licensing details. Until I receive this information, please treat this debt as disputed and cease all further collection activities. My attorney will also file a claim/complaint with the CFPB pursuant to the above if not provided. The response from them via CFPB were some account statements and an email saying the debt had be transferred to them. I have the right to have this supposed debt validated by being provided the above information. That is supposed to happen within 30 days of the request. It's not been over 60, allowing time for mail to deliver. I have not had this debt validated and want this account removed. The response they sent to the above request can be seen on the closed complaint I submitted prior to this one.
