On XX/XX/year> we lost our home to a huge house fire. We contacted our mortgage company shellpoint on XX/XX/XXXX and they sent a rep out on XX/XX/XXXX, they took pictures and said that this was a total loss. We also found out that they had placed a hazzard insurance policy on our home with them ( Shellpoint ) as the only one covered and the policy holder. We only owed XXXX dollars left on the home at the time of the loss. We reached out to XXXX XXXX XXXX XXXX because that was the insurance company listed on the policy to find out what was going on. They stated that they sent a check out on XX/XX/year> that would cover the pay-off of the loan, plus additonal funds. However it has yet to be applied to the balance of our loan for the complete pay-off. This home is a mobile home and can not be rebuilt nor do we wish to, so there is no reason at all for shellpoint to be holding on to this check, and for us to keep continuing to make mortgage payments on this completely burned home. We have made XXXX more payments on this home since its burned down, and the mortgage company is sitting on a XXXX dollar check. We believe they are doing what we call double dipping which is illegal. We can not buy another home with this open mortgage loan.
