RE : XXXX XXXX After I received correspondence from your agency, it stated that the accounts I disputed were verified by your agency. Pursuant to 15 U.S. Code 1681i ( a ) 1 ( a ), I am demanding that your agency perform a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the status of the disputed information. Pursuant to 15 USC 1681e ( b ) please complete this inaccurate account or delete it from my consumer reports. The Law Cleary States : ( a ) Reinvestigations of disputed information ( 1 ) Reinvestigation required ( A ) In general Subject to subsection ( f ) and except as provided in subsection ( g ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. I am requesting that you validate the following items non-electronically, by performing a reasonable and FAIR re-investigation : Please provide the following details of the methods by which you verified these accounts : a. Identity and position of the representative contacted? b. Date, duration, and substance of the conversation? c. Contact details utilized? d. Identity, position, and tenure of your company 's employees involved? e. Details of formal training imparted to said employee? f. Copies of all written correspondence? Your agency also seems to be in violation of non-compliance and negligent non-compliance with being in direct violation or the following laws : 15 U.S. Code 1681n - Civil liability for willful noncompliance ( a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater ; ( 2 ) such amount of punitive damages as the court may allow ; and ( 3 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. ( b ) Civil liability for knowing noncompliance Any person who obtains a consumer report from a consumer reporting agency under false pretenses or knowingly without a permissible purpose shall be liable to the consumer reporting agency for actual damages sustained by the consumer reporting agency or {$1000.00}, whichever is greater. These are now multiple attempts to handle this matter privately. If these accounts keep getting verified by a faulty XXXX system when I know these accounts are erroneous and destroying my credit worthiness, I will in fact sue your agency for the maximum monetary damages that the FCRA allows. Your agency has less than 30 days to respond with a fair reasonable re-investigation or I will have no choice but to seek legal action. This investigation must be validated by the information that I have listed above. If the information is not validated, then it must be deleted immediately from my consumer report!
