Consumer Narrative
I am filing this complaint due to an inaccurate debt reported on my credit file by NATIONAL CREDIT SYSTEMS, which claims I owe a balance from an apartment lease. This debt does not belong to me, and I have disputed it with the collection agency. Despite this, they continue to report it on my credit report without providing legally sufficient validation. The collection agency initially provided an electronic signing transcript as validation, but it does not include a verifiable signature tying me to the debt. This transcript is merely metadata showing signing activity and lacks any authentic, legally binding evidence of my agreement to the lease. Since I did not sign this lease, I have a valid basis for an identity theft claim. In response to my dispute, I requested : Immediate removal of the account from my credit report due to insufficient validation and lack of a verifiable signature. Proof of authorization from the original creditor allowing the collection agency to collect and report this debt. Despite these requests, the collection agency has failed to comply, resulting in an unwarranted negative impact on my credit score. This is a violation of both the Fair Credit Reporting Act ( FCRA ) and Fair Debt Collection Practices Act ( FDCPA ) requirements to provide legitimate validation and cease collection activity when an account can not be authenticated.
