This is my second attempt to fix the issue of XXXX, EQUIFAX, AND XXXX XXXX, disclosing my NONPUBLIC PERSONAL INFORMATION, MY PERSONALLY IDENTIFIABLE FINANCIAL INFORMATION, being illegally displayed per 15 U.S.Code 6803 ( a ) ( 1 ) - Disclosure of institution privacy policy, which is clearly violating my privacy under the Privacy Act of 1974. I have Sent Self Financial Incorporation an opt-out letter demanding that my previous consent of sharing my information with affiliates and non-affiliates be REVOKED, therefore them reporting my information to XXXX, Equifax, and XXXX XXXX should not be taking place. By XXXX, XXXX XXXX, and Equifax exposing my nonpublic personally identifiable information, that is leaving the window open to my information being vulnerable to identity theft and also is violating several of the the following laws. Per the I.R.S. PUBLICATION 4681 ( XXXX ), CANCELED DEBTS, FORECLOSURES, REPOSSESSIONS, AND ABANDONMENTS, which states the following in the section labeled introduction : This publication explains the federal tax treatment of canceled debts, foreclosures, repossessions, and abandonments. Generally, if you owe a debt to someone else and they cancel or forgive that debt for less than its full amount, you are treated for income tax purposes as having income and may have to pay tax on this income. Therefore income is nonpublic personal information that is not to be disclosed to be disclosed to affiliates and nonaffiliated third parties which is a violation of my privacy under the PRIVACY ACT OF 1974, per 15 U.S.C. 6803 DISCLOSURE OF INSTITUTION PRIVACY POLICY. Nonpublic Personal Information is defined as follows from 15 U.S.C. 6809 ( 4 ) ( 4 ) Nonpublic personal information ( A ) The term " nonpublic personal information '' means personally identifiable financial information- ( I ) provided by a consumer to a financial institution ; ( II ) resulting from any transaction with the consumer or any service performed for the consumer ; or ( III ) otherwise obtained by the financial institution. XXXX is also in violation of 15 U.S. Code 1681 - Congressional findings and statement of purpose, which states : ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. THIS ACT SPEAKS VOLUMES OF HOW MY CONSUMER RIGHTS HAVE BEEN WILLFULLY VIOLATED BY XXXX XXXX. This unlawful act has damaged my ability to access consumer rights to credit. As Congress stated in 15 U.S. Code 1681 - Congressional findings and statement of purpose, ( 3 ) Consumer reporting agencies have ASSUMED ( NOT ELECTED OR PLACED, BUT ASSUMED ) a vital role in assembling and evaluating consumer credit and other information on consumers. Therefore as congress stated, ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. Also, XXXX, Equifax, and XXXX XXXX have violated 15 U.S.Code 1681 inaccurate reporting by listing several items on the report that does not match up with the accurate information. Equifax, XXXX XXXX, and XXXX have voluntarily reported unlawful personally identifiable information on my consumer credit report since XX/XX/XXXX. As a federally protected consumer, I depend upon federal government agencies as a vessel to help enforce my consumer rights when needed as stated in the Consumer Financial Protection Act of 2010 which states : ( a ) In general Subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511 et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau of Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law, as follows : ( 1 ) In general Except as provided in paragraph ( 2 ), the agencies and authorities described in subsection ( a ), other than the Bureau of Consumer Financial Protection, shall implement the standards prescribed under section 6801 ( b ) of this title in the same manner, to the extent practicable, as standards prescribed pursuant to section 1831p1 ( a ) of title 12 are implemented pursuant to such section.IN CLOSING, I AM SEEKING JUSTICE BE PREVAILED FOR THE VIOLATION OF MY PRIVACY UNDER THE PRIVACY ACT OF 1974. Reporting Transaction history is illegal. Per 15 USC 1681b Permissible purposes of consumer reports -In accordance with the written instructions of the consumer to whom it relates. Also, The U.S. Code section that makes it a crime to deprive someone of their rights is 18 U.S.C. 242. This law prohibits government officials from depriving someone of their rights or privileges protected by the Constitution or laws of the United States. This includes actions taken by law enforcement officers, judges, and other public officials.
