Texas repossession laws state the vehicle can not be sold within 10 days, the car was taken on XX/XX/XXXX in the middle of the night on a XXXX XXXX when calls couldn't be made to make a payment and when account was removed from the app, taken from repo lot on XX/XX/XXXX, sold on XX/XX/XXXX all without a notice of intent provided. I was told it was sent on through certified mail on XX/XX/XXXX, XXXX is XX/XX/XXXX and I still have not received anything. The XXXX and surplus letter were not provided to be after the sale, and I was told on XX/XX/XXXX it was mailed out through certified mail on XX/XX/XXXX. Again, I have not received either of the XXXX and I called and stated that on a recorded line. They would have confirmation that I received it through tracking, or it gets returned to sender according to the post office. The vehicle sold for XXXX and that amount was applied on XXXX, leaving a remainder of XXXX. Why was I asked to pay XXXX in full by the XXXX XXXX XXXX XXXX lot to receive my car. XXXX XXXX XXXXXXXX XXXX last XXXX of XXXX XXXX XXXX. I was only offered XXXX solution by the charge off department, and that was to do a sales hold of XXXX, XXXXXXXX XXXX a max of two times. That was only offered after it was at the auction and that just prolongs the hold. I believe there was never an attempt to collect past due, they cut corners to get the car back. I have documentation from the credit bureaus stating the XXXX past due reported was 90 days. If they do not report correctly, how I am to trust this? The XXXX XXXX XXXX doesn't state this, and I spoke with XXXXXXXX XXXX XXXX XXXX specialist at XXXX on a recorded line on XX/XX/XXXX at XXXXXXXX XXXX, she stated the account was charged off at XXXX XXXX on XX/XX/XXXX due to being 126 days past due, then I was told Text and emails are a courtesy, and a phone call is the most accurate way to communicate. The app is where customers pay, and should have the most up to date, real time info, unless they are trying to hide something. This has impacted my family greatly ; I am unable to get to and from work without my vehicle and obtaining a vehicle with the false information on my credit is hindering me from getting another vehicle. They keep reporting on this account even though it was charged off on XX/XX/XXXX. I made a complaint earlier last month and they attempted to update the info but it's still incorrect.
