I never had an transactions with either XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX So, I filed an Identity Theft Affidavit with the Federal Trade Commission as I believe that I was a victim of Identity Theft. I sent a copy of the fraud affidavit to the credit bureaus and the reporting agency asking them to remove this fraudulent account from my credit report and they refused and failed to do so and this is a clear violation of the Fair Credit Reporting Act The law is explained below : The section of the Fair Credit Reporting Act ( FCRA ) that addresses the removal of fraudulent information related to identity theft is Section 605B ( 15 U.S.C. 1681c-2 ), which is titled " Blocking of Information Resulting from Identity Theft. '' This section states that when a consumer provides a credit reporting agency with an identity theft report, the agency must block the reporting of the fraudulent account or information from the consumer 's credit report. Specifically, it requires the credit reporting agencies to remove or block the reporting of information that is the result of identity theft within four business days after receiving : 1 ) Appropriate proof of the identity of the consumer. 2 ) A copy of an identity theft report ( such as an affidavit ). 3 ) The identification of such information by the consumer. 4 ) A statement by the consumer that the information is not related to any transaction of the consumer. The consumer must submit an identity theft affidavit or report ( often obtained through law enforcement or an affidavit via the FTC ). Upon receiving the documentation, the credit reporting agency is obligated to block the fraudulent information from appearing on the consumers credit report. I have am submitting once again a copy of the fraud affidavit that I had submitted before and I am asking you to delete the account called XXXXXXXX XXXX XXXX from my credit report immediately. A failure to do so will result in taking legal actions against your company for violating my rights under the Fair Credit Reporting Act. Delete the account called XXXX XXXX from my credit report immediately. I have attached a copy of the law that deals with identity theft and the reporting of such information on the person 's credit report. kindly see file attached.
