Consumer Narrative

Subject : Dispute of Unlawful Collection Activity by National Credit Systems and XXXX XXXX XXXX I am submitting this complaint against National Credit Systems ( NCS ) and XXXX XXXX XXXX regarding a collection account that has been reported on my credit without proper notification or due process, in violation of the Fair Debt Collection Practices Act ( FDCPA ) and the Fair Credit Reporting Act ( FCRA ). Complaint Summary : Collection Account : On XX/XX/2024, NCS opened a collection account on my credit report for a balance of {$7400.00}, allegedly owed to XXXX XXXX XXXX This collection has been updated as recently as XX/XX/2024. No Notification : Neither I nor my fiance ( who was also associated with the lease ) were notified of this debt prior to it being reported to the credit bureaus. We did not receive any communicationvia phone, mail, or emailabout this collection, violating our rights under FDCPA and FCRA. Invalid Lease Agreement : The lease agreement provided by NCS is unsigned by me or my fiance, making it invalid. The charges being collected are not based on a valid legal contract. False Move-Out Reason : NCS has reported that we skipped without notice. In reality, I have proof that my acces s to the apartment was revoked for two days, which forced us to move out. My fiance and I visited the management office in person over five times to try to resolve this issue, but we were repeatedly ignored, and our access was never restored. Evidence Provided : 1. Emails to Management : I have attached email screenshots showing my attempts to contact the management team about the access issues. Despite my efforts, no response was provided. 2. In-Person Attempts : Both my fiance and I visited the management office over five times in person to resolve the access problem. However, the management was dishonest, repeatedly sending their staff to our apartment during the day to let us in. After the office closed, we were still unable to access our apartment, and no assistance was provided to restore our access. 3. Video Evidence of Revoked Access : I have provided video evidence showing that my access to the apartment was revoked for two days. Management falsely claimed the access issue affected all residents, but our neighbors still had access, further confirming the discriminatory nature of this action. 4. Proof of Returned Items and Apartment Condition : I have attached documentation proving we returned all keys ( including house, mailbox, and parking permit ) when we moved out, along with photos showing the apartments condition upon our departure. Impact on My Credit and Financial Situation : This collection has significantly impacted my credit score, and I am currently in the process of buying a home using an FHA loan. This wrongful collection is putting my home purchase at risk, and it has caused undue financial stress. Thank you for your attention to this matter. I have attached all relevant evidence, and I am available to provide further documentation if needed. All the videos that shows our fob access and PIN code access revoked, proof that we returned the keys to the office mail box because I have went to the office two days and they were off and parking permit and the condition of the house when we left are more than 10 MB so thats why I couldnt attached it here. I can provide all this videos if there is any other possible way to send it.
