On XX/XX/XXXX, I received a notice of assignment, sale, and transfer from Statebridge Company LLC ( XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX as Trustee for XXXX XXXX XXXX ). Their contact information is XXXX XXXX XXXX XXXX XXXX XXXX. XXXX XXXX, CO XXXX. XXXX XXXX. ( XXXX ) XXXX. Fax : ( XXXX ) XXXX XXXX. I called my mortgage company, and they indicated that my mortgage had not been assigned, sold, and/or transferred. On XX/XX/XXXX, I received a debt collection notice from Statebridge Company LLC ( for {$40000.00} ). I received an additional debt collection notice from Statebridge Company LLC on XX/XX/XXXX ( for {$17000.00} ). I returned their forms with the box checked, " this is not my debt. '' I have since found out that a loan was taken out on XX/XX/XXXXXXXX that I have no knowledge of. Or, that I have ever been contacted about until XX/XX/XXXX. In response to my forms checked this is not my debt. I received a notice from Statebridge Company LLC dated XX/XX/XXXXXXXX That notice indicated a " cease and desist placed on the file. You will not receive anymore phone call, statements, or other documents '' However, after the above date. I continued to receive debt collection notices on XXXX XXXXXX/XX/XXXX ( first notice ), XX/XX/XXXX ( second notice ), and a letter dated XX/XX/XXXX. I consider this harassment. In response, I sent a letter on XX/XX/XXXXXXXX to Statebridge Company LLC. In that letter, I pointed out that there is an article in the XXXX XXXX XXXX XXXXXX/XX/XXXX ) which pointed out that, " Reviving old debt is a common ploy among unscrupulous debt collectors. They may buy debt thats past the statute of limitations for pennies on the dollar then seek to dupe the debtor into making even a tiny payment Under most statutes of limitations, making a payment, even a partial one, resets the clock ... '' In my letter dated XX/XX/XXXXXXXX I asked Statebridge Company LLC the following questions : 1 ) Did you first begin contacting me on XX/XX/XXXX, about a debt incurred in XXXXXXXX 2 ) Do you know the statute of limitations for debt in California is four years ( Code of Civil Procedure 337 )? XXXX ) So isnt the statute of limitations for a debt incurred in XXXXXXXX the year of XXXXXXXX 4 ) Are you trying to trick me into making a partial payment to reset the clock? 5 ) Do you know that Section 807 of the Federal Fair Debt Collection Practices Act says that a debt collector may not use any false, deceptive or misleading representation or means in connection with the collection of any debt? 6 ) Do you know that California Civil Code Section 1788 also prohibits a debt collector from using false, deceptive or misleading representation or means to collect a debt? XXXX ) Are you aware of the numerous XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX reviews accusing you of using false, deceptive and misleading means to collect a debt? 8 ) Are you aware that you are being monitored by the XXXX XXXX XXXX due to overwhelming consumer complaints about violations of the Fair Debt Collection Act? 9 ) Did you know the XXXX XXXX XXXX has not accredited your business, and has assigned you a XXXX XXXX 10 ) Did you know that there is a class action suit against you for unlawfully reporting to the credit bureaus debts that were delinquent more than seven years? 11 ) Are you trying to unlawfully report a charged off debt regarding me? I never received a response from Statebridge Company LLC for any of the above questions. But in retaliation, I received a letter from them dated XX/XX/XXXX, threatening all of the following : to accelerate the loan ; start foreclosure by judicial proceedings ; sell the property; gave notice of default ; will report this default, and all foreclosures to the major credit bureaus ; and will file suit to seek deficiency judgments against borrowers. To sum up, fraud means wrongful or criminal deception intended to result in financial or personal gain. Statebridge Company LLC is trying to revive an old debt from XXXXXXXX But the statute of limitations is XXXX years ( Code of Civil Procedure 337 ). The statute of limitations ended in XXXXXXXX As a result, the debt is no longer collectible. I am asking Statebridge Company LLC to stop all collection efforts as a result. Thank you
