Consumer Narrative

I am currently facing an issue with a debt collection companies that are reporting on my credit report, which I believe is in violation of the Fair Debt Collection Practices Act ( FDCPA ). Specifically, I have no contracts or agreements with this company. This company has not provided any documentation containing my signature that authorizes them to report on my credit or engage in business with me. The following are the specific FDCPA laws that I believe these debt collection companies have violated : 809 Validation of Debts ( 15 U.S.C. 1692g ) : Debt collectors are required to provide verification of the debt within XXXX XXXX of the initial communication. They must send a written notice containing the amount of the debt, the name of the creditor, and a statement that unless the consumer disputes the debt within XXXX XXXX it will be assumed valid. In this case, the above-mentioned debt collection companies have not provided such validation or verification of the debt. 807 False or Misleading Representations ( 15 U.S.C. 1692e ) : Debt collectors are prohibited from using any false, deceptive, or misleading representation in connection with the collection of any debt. Reporting to credit bureaus without a legitimate basis and without proper documentation or contract constitutes a misleading representation of the debt 's validity. 808 Unfair Practices ( 15 U.S.C. 1692f ) : Debt collectors may not use unfair or unconscionable means to collect or attempt to collect any debt. Reporting a debt to credit bureaus without having the proper contractual authority or verification is considered an unfair practice. 818 Furnishing Certain Deceptive Forms ( 15 U.S.C. 1692j ) : It is illegal for debt collectors to design, compile, and furnish any form knowing that it would be used to create a false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes. Given the lack of documentation and absence of a contractual agreement, the actions of this company is in violation of the aforementioned provisions of the FDCPA.
